South Korea releases a partially revised draft of the Enforcement Decree of the Law Concerning the Labeling and Advertisement of Food Products, etc., proposing to raise the fine levied for false labeling of nutritional content.

On March 21, the Ministry of Food and Drug Safety (MFDS) of Korea issued Announcement No. 2024-138 to amend the Enforcement Decree of the Law Concerning the Labeling and Advertisement of Food Products, etc. in part.
The main contents are as follows:
To delegate to local food and drug safety agencies the matters related to the prohibition of drug labeling and change of similar labeling on food products, and to amend the law to prohibit the actual measurement value of nutrient content that exceeds the nutrient content labeling.
The proposal also strengthens consumers' right to know by increasing the fine for cases where the actual measured value of the nutrient content exceeds 100% of the labeled nutrient content, or where the labeled nutrient content fails to meet the standard.

The consultation period ends on April 30, 2024, for the above opinions.
